EU Law Rights and Remedies before National Courts: Continuity and Change
Jean Monnet Chair "Civic Engagement, Rights and Remedies in EU Law"
28-30 May 2025 | Turin - Luigi Einaudi University Campus
National courts are the frontline and day-to-day enforcers of EU law, sharing with the Court of Justice of the European Union the key task of ensuring its correct, uniform and consistent application in the Member States. Over the decades, they have contributed decisively to the development of the allegedly comprehensive system of remedies that characterises the EU legal order. To this end, they can rely on a wide set of tools, ranging from direct eff ect and disapplication to the power to raise on their own motion the incompatibility of national legislation with EU law and the Member States’ liability for violations of EU law. These remedies have silently and continuously evolved over time, under the pressure of the demand for a more eff ective protection of fundamental rights. Yet, they are not immune to the increasing contestation of the primacy of EU law, with the ‘safe third country of origin saga’ being just the latest example of heated institutional confrontations. The Turin Spring School, organised by the Law Department of the University of Turin (Hub 1 – Institutions and Justice), aims to revisit the system of EU remedies before national courts, through a combination of lectures and seminars.
Confirmed Speakers: Joana Mendes (Luxembourg University), Daniele Gallo (LUISS University Rome), Mathieu Leloup (Ghent University), Luke Dimitrios Spieker (Humboldt University Berlin), Joyce de Coninck (European University Institute), Marcella Ferri (University of Florence).
